We are not liable for shipping or delivery delays.

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing or circumstances outside our reasonable control.

Once products are transferred to the applicable carrier, title and risk of loss pass to you, subject to any rights you may have under applicable consumer law.

However, purchases made through our store are made directly with Seoul Sundays.

By using the Services, you acknowledge and agree that Shopify is not responsible for sales between you and Seoul Sundays, including injury, damage or loss resulting from products or services purchased through our store.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions made directly with Seoul Sundays.

WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

SOME JURISDICTIONS LIMIT OR PROHIBIT CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

These Terms & Conditions and any policies or operating rules posted by Seoul Sundays constitute the entire agreement between you and us regarding your use of the Services and supersede prior or contemporaneous agreements, communications and proposals relating to the Services.

You may not delegate, transfer or assign these Terms or your rights or obligations under them without our prior written consent.

We may transfer, assign or delegate these Terms and our rights and obligations subject to applicable law.

These Terms & Conditions and any separate agreements through which we provide Services shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Seoul Sundays is headquartered, without limiting any mandatory consumer protections that apply to you.

You and Seoul Sundays consent to the jurisdiction of the applicable courts, subject to rights you may have under applicable consumer law.

We reserve the right to update, change or replace portions of these Terms by posting updates to our website.

Where required by applicable law, we will provide notice of material changes before they become effective.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, subject to applicable law.

SECTION 24 - LOYALTY MEMBERSHIP & RECURRING BILLING

All purchases made through Seoul Sundays include enrolment in our Loyalty Membership Program.

Membership provides access to benefits such as exclusive member pricing and discounts, promotional offers, early access to selected product releases and other member-only benefits offered from time to time.

The Loyalty Membership is billed at $34.99 USD every 30 days, beginning from the date of your initial order.

By completing a purchase and providing your payment information, you expressly authorise Seoul Sundays to charge your payment method for your initial order and the recurring membership fee of $34.99 USD every 30 days until cancelled.

You may cancel your membership at any time through our subscription cancellation form or by contacting us at hello@seoulsundays.com.

Cancellation will prevent future membership charges. Your membership benefits will remain available until the end of your current paid billing period.

Membership fees already charged are non-refundable, except where otherwise required by applicable law.

If a recurring payment is unsuccessful, we may retry the payment, suspend or restrict membership benefits, or cancel the membership after multiple unsuccessful payment attempts.

We may change the membership fee from time to time by providing advance notice before the new pricing takes effect. Continued membership after the effective date of a pricing change constitutes acceptance of the revised fee, subject to applicable law.

Seoul Sundays reserves the right to suspend or terminate a membership in circumstances involving fraud, abuse, misuse, chargebacks or breaches of these Terms & Conditions.

By placing an order, you acknowledge and agree to enrolment in the Loyalty Membership Program and the recurring membership charge described above.
